Attention OPWDD Providers: OMIG Releases Compliance Guidance for Corporate Compliance Programs

The New York State Office of the Medicaid Inspector General (OMIG) has released Compliance Guidance for use by providers regulated by the New York State Office of Persons for Developmental Disabilities (OPWDD).

The routine identification of compliance risk areas, relating to the particular type of services being offered by Medicaid providers, is required for certain providers in accordance with the New York State Social Services Law Section 363-d and implementing regulations at 18 NYCRR Part 521. The purpose of the OMIG’s Compliance Guidance is to give examples of compliance risk areas that may be of particular concern to those providing Day Habilitation, Day Treatment, Residential Habilitation, and Medicaid Service Coordination services. Many of these are taken from OMIG Audit Protocols for Office for People with Developmental Disabilities (OPWDD) programs and services which can be found on OMIG’s Web site at www.omig.ny.gov.

OIG finds DOH should refund nearly $8 million to federal government

In a recent audit of the New York State Department of Health (DOH), the Office of the Inspector General of the United States Department of Health and Human Services (OIG) found that several New York City area providers billed Medicaid for services that did not meet state and federal requirements.  OIG recommended that DOH refund nearly $7.8 million to the federal government and that the both DOH and the New York State Office for People with Developmental Disabilities (OPWDD) alter its policies and procedures. Gov. Cuomo Announces Task Force to Review Taxpayer Funded Not-for-Profits

On Wednesday, August 3, 2011, Governor Cuomo announced that he has created a new task force to “to investigate the executive and administrator compensation levels at not-for-profits that receive taxpayer support from the state.”  Although the task force will presumably review all taxpayer funded non-profits, the press release from the Governor’s office acknowledged that the creation of the task force was a reaction to reports of excessive executive compensation at non-profits funded with Medicaid dollars through the Office of People With Developmental Disabilities (OPWDD).  One of these reports was an August 2, 2011, front-page article in the New York Times which questioned executive compensation at New York City non-profits that serve the developmentally disabled.  That report noted that New York spends $10 billion annually to service the developmentally disabled, with half of that amount going to private providers.
